Ilaiyaraaja has sent a legal notice to producer – director Shankar for using one of his popular song ‘Ooru vita or vanthu..’ from blockbuster Karagaattakaran in his latest film Kappal without taking prior permission. Kappal which was released on Christmas is running successfully. Film is jointly produced by Shankar’s ‘S’ Pictures and I studios, and directed by debutant Karthik G. Krish, a former assistant of Shankar.
Natarajan Sankaran has scored the music for the film. The notice says that Shankar should immediately remove the song from the film and provide necessary compensation for his act failing which a case would be filed against him. Similar notices have also been sent to Krish, Jayaram (one of the producers) and Sankaran.
Notice from Ilayaraja’s lawyer S.K.Ragunathan says the following – “You have used the Ooru vittu ooru vandhu song of my client without prior permission. At a time when the court has restrained Aki Music from selling songs of Ilaiyaraaja, who has scored music for 1000 films in various languages, the act of taking the song from Aki and using it in the film amounts to contempt of Court. Ilaiyaraaja owns the copyright of the song and all other songs. As such, royalty should be paid to him for using the song on screen, on radio and in other advertisements. The song sequence should be removed from the film failing which my client would be forced to file civil case and cases under the Copyright Act”.
